The SCA found the municipality had violated legal principles by levying excessive rates and ordered the municipality to credit the overcharged amounts back to the farmers. 07 Mar 2023  |  lowvelder.co.za
The City of Mbombela faced a legal setback on March 7 when it attempted to force two schools to pay approximately R8.8 million in alleged overdue electricity bills by cutting off their power. Hoërskool and Laerskool Nelspruit, along with Lowveld High School, have been in a dispute with the city council since 2012 over these bills. The schools' legal representative, Vernus Kruger, argued that the bills were incorrectly calculated. Despite a court order prohibiting the city from cutting off power, the city did so on March 3. The schools obtained an urgent court order to restore power, which was made permanent on March 7. The city council is now prohibited from disconnecting power until the ongoing court case is resolved. The schools had previously won a court order in 2012 preventing the city from taking debt collection actions, and the city withdrew its claims in 2016. However, the city filed a new claim in 2022, which is still pending.
